Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Rawshow AI Technologies ("Company", "we", "us", or "our"), a business based in Mysore, Karnataka, India, regarding your use of the Rawshow AI platform and associated services (collectively, the "Service").

By registering for an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

If you are using the Service on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

2. The Service

Rawshow AI provides an outbound sales automation platform that allows users to:

• Build and run automated outreach sequences across email, LinkedIn, SMS, and other channels
• Import, manage, and enrich sales leads
• Create and manage email and messaging templates
• Connect third-party integrations including CRM systems, email providers, and enrichment tools
• Access analytics and reporting on outreach performance

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Accounts and registration

3.1 Eligibility

You must be at least 18 years of age to use the Service. By registering, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

3.2 Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use a strong, unique password for your account
• Not share your login credentials with any third party
• Notify us immediately at billing@rawshowai.com if you suspect unauthorised access
• Ensure that all information you provide is accurate and up to date

We are not liable for any loss resulting from unauthorised use of your account caused by your failure to keep your credentials secure.

3.3 One account per user

Each account must be registered with a unique email address. You may not create multiple accounts to circumvent usage limits, abuse free trials, or for any other reason.

4. Subscriptions and billing

4.1 Free trial

We offer a free trial period as described on our pricing page. No payment information is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service or your account will be restricted.

4.2 Subscription plans

Paid subscriptions are billed in advance on a monthly or annual basis as selected. All prices are displayed on our pricing page and are inclusive of applicable taxes where required by law.

4.3 Payment processing

Payments are processed securely by Razorpay. By subscribing, you authorise us to charge your chosen payment method on a recurring basis until you cancel. You agree to Razorpay's terms of service in addition to these Terms.

4.4 Cancellation

You may cancel your subscription at any time through your account billing settings or by contacting us. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods except where required by applicable law.

4.5 Price changes

We reserve the right to change subscription prices with at least 30 days' advance notice. If you do not agree to a price change, you may cancel before it takes effect.

4.6 Failed payments

If a payment fails, we will notify you and retry. If payment remains outstanding after 7 days, your account may be suspended until the balance is settled.

5. Acceptable use policy

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must NOT use the Service to:

• Send unsolicited bulk communications (spam) in violation of applicable law
• Contact individuals who have opted out or unsubscribed from communications
• Impersonate any person or entity or misrepresent your affiliation
• Transmit any material that is unlawful, harmful, defamatory, or obscene
• Conduct any illegal activity including phishing, fraud, or identity theft
• Violate the privacy rights of any individual
• Attempt to gain unauthorised access to any system or network
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Resell or sublicense the Service without our written permission
• Use the Service in a way that could damage, disable, or impair our infrastructure

We reserve the right to suspend or terminate accounts that violate this policy without notice or refund.

6. Your data and content

6.1 Ownership

You retain full ownership of all data you upload to or create within the Service, including lead lists, templates, and workflow configurations ("Your Content"). You grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the Service to you.

6.2 Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of Your Content. You represent and warrant that you have obtained all necessary consents and permissions to upload and process any personal data of third parties within the Service.

6.3 Data portability

You may export your data at any time while your account is active. Upon account termination, data export functionality will remain available for 14 days, after which your data will be deleted in accordance with our Privacy Policy.

7. Intellectual property

The Rawshow AI platform, including its software, design, code, branding, logos, and all content created by us, is the exclusive property of Rawshow AI Technologies and is protected by applicable intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in the platform other than the limited right to use it in accordance with these Terms. You may not copy, reproduce, distribute, or create derivative works of our platform without our written consent.

8. Limitation of liability

To the maximum extent permitted by applicable law, Rawshow AI Technologies, its founders, employees, agents, and partners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages arising from your use of or inability to use the Service
• Damages arising from unauthorised access to your account or data
• Damages arising from third-party actions, including reactions to your outreach
• Any interruption, suspension, or termination of the Service

Our total cumulative liability to you for any claims arising from these Terms or your use of the Service shall not exceed the total amount paid by you to us in the 3 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Rawshow AI Technologies, its founder Shylesh E N, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these Terms
• Your violation of any applicable law or regulation
• Your outreach to third parties using the platform
• Any claim that Your Content infringes the rights of a third party
• Your wilful misconduct or negligence

10. Termination

10.1 Termination by you

You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion. We will process your request within 30 days.

10.2 Termination by us

We reserve the right to suspend or terminate your account immediately and without prior notice if:

• You breach any provision of these Terms
• You engage in fraudulent, abusive, or illegal activity
• Your use of the Service poses a risk to our infrastructure or other users
• We are required to do so by law

10.3 Effect of termination

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall survive.

11. Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Mysore, Karnataka, India.

12. Changes to these Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and by a notice on the platform at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.
